Players’ Lawsuit Against the NFL Still Has Life

Thousands of former players and family members filed a lawsuit against the NFL and others for injuries the players received during their professional football careers.  On the surface, their claims may seem a bit ridiculous, but a deeper look reveals claims of negligence and fraud against the behemoth football organization and its equipment suppliers. Riddell, Inc., the company that manufactures football helmets for the NFL, is one of the suppliers named in the players’ master complaint.

The backbone of the former players’ legal complaint is that the NFL concealed information connecting football play with concussions and other traumatic brain injuries.  As we have reported in earlier articles, TBI can lead to permanent and debilitating brain disorders such as dementia and Alzheimer’s disease.

The NFL itself began setting the stage for this lawsuit in 1994, when NFL Commissioner Paul Taglibue created the Mild Traumatic Brain Injury Committee.  Thereafter, individual NFL teams, doctors and trainers had little choice other than to comply with the MTBI Committee’s instructions about player safety and concussions, despite the fact that some team doctors disagreed with the research results of the MTBI Committee.  The plaintiffs claim team doctors were silenced or shunned on numerous occasions.

The most recent status of the players’ lawsuit is that the judge is awaiting further briefing by the NFL on its motion to dismiss.  The NFL must respond in writing by December 17, 2012.  We will continue to keep an eye on this case as it progresses through the courts.
