DEFENDING DUI/DWI

DUI and DWI are serious charges and can come with serious consequences. Under Maryland law, A DUI conviction carries with it a possible $1,000.00 fine, 1 year in jail or both and 12 points on your Maryland driving record which can lead to your driving privileges being revoked. A DWI conviction carries a $500.00 fine, 60 days in jail and 8 points which can lead to a suspension of your driving privileges.

In addition to being charged by the police and having to go to Court, you may also face administrative consequences from the MVA. Maryland’s Implied Consent laws provide that if you are stopped and are suspected of drinking and driving and you either refuse to take a breath test or take the breath test which results in a .08 or higher reading, you could face the loss of your driving privileges. The penalties vary depending upon the circumstances. You have the right to have an Administrative Hearing to determine whether your driving privileges should be modified to allow you to drive your vehicle for work or even if your driving privileges should be suspended at all. However, you must request that Administrative Hearing within 10 days of being charged, otherwise you may still be suspended or worse yet, give up the right to have a Hearing.

The following are the possible Administrative penalties for a first time DUI:
